Over the weekend, the Mexican Senate released the final draft of a law that will regulate the consumption, production, harvesting, packaging, distribution, and cultivation of cannabis.

In 2018, the country’s Supreme Court found that the ban on adult cannabis use to be unconstitutional. And gave legislators one year to legislate a new legal framework.

However, the project stalled as Mexican legislators were not ready to publish the new rules surrounding legalization. Legislators have also been under pressure from the government health agency to clarify the laws surrounding medical cannabis. Which legalized in June 2017.

The Senate will now have to debate the bill and pass it in its next session from February to April.

The new proposal

In the latest proposal, the bill authorizes the possession of 28 grams of cannabis for personal use. For an authorization to possess between 28 and 200 grams. Mexicans will be able to apply for a license from the Mexican Cannabis Institute. A government agency expected to open on 1 January 2021. Home cultivation expanded from four plants to six.

The new Senate proposal also states that communities that have been affected by drug trafficking and crime more broadly will be given priority for the licensing of cannabis cultivation. A licensee would be limited to cultivating cannabis on one hectare of land outdoors or 1,000 square meters indoors.

If the proposal becomes law. The Mexican Cannabis Institute will also issue separate licenses for the preparation of cannabis for sale. The marketing of the plant and its derivatives and the import and export of cannabis products.

Edible products and beverages infused with cannabis containing more than 1 % THC will be illegal, as will cannabis cosmetics.

In addition, it would grant permits for research on the cultivation of cannabis for commercial purposes. The institute would no longer be responsible for setting taxes on cannabis, as previously proposed.

The new law would also guarantee access to medical cannabis for people with serious health problems.
